Insurance Law

Insurance law protects consumers and insurance companies by setting boundaries which would be considered violations of insurance law if crossed.

The content of insurance law varies from country to country and can be quite a complex area as some claims cover a variety of different jurisdictions. and has lawyers specialising in the field of insurance law, which shows just how complex insurance matters can become.  In relation to the European Union, each Member State has their own insurance regulators.  However the EU has introduced a harmonised regime which allows an insurer regulated by a UK regulator, such as the Financial Services Authority, to establish a branch in other Member States.

The concept behind insurance law is that is allows people to prepare for an event where they would have to pay unexpected amounts of fees. The typical scenarios where insurance pay outs are when buying cars, or if they someone is the sole provider of their family and are concerned that if they die they will not be able to provide for them (life insurance), business or home insurance.

From a consumer point of view, the problem with dealing with insurance companies is that they are just so big and cash rich that they sometimes ignore the consumer if they have a complaint of consider that they have not been treated properly. The aim of insurance law is to address this imbalance by allowing provisions for appeals from consumers who have been denied coverage such as denying coverage to people considered insurance risks. Insurance law also provides protection to businesses in the event of insurance fraud. The law also includes a list of activities which are considered illegal, such as businesses collaborating with consumers to commit fraud.

The laws relating to insurance cover a wide variety of topics. They specify what the terms of insurance policies should contain, how claims should be processed, the strategies insurance companies can use to advertise, and the types of limitation clauses available to companies. They may also specify which situations people are expected to hold insurance such as when registering a car of if becoming a home owner.
